fincy serves the software fincy photoshop for the purpose of publishing and selling of photos, based on the AGB specified here.
Contents of fincy photshop are the web based presentation of photos of the member or buyer as well as the sale of physical goods further on named as Gadets and the sale of downloads of the photos.
Further contents of fincy photshop are data of the photos, like titles, descriptions, data of the camera and the categorizing of the photos.
Further contents of fincy photshop are data of the member and interactive functions between members.

Interactive functions are in particular the possibility to enter comments to the photos, functions to form an informal, friendly community of photographers and possibilities of the individual evaluation of photos of individual members on the basis of given values.
Functions for the formation of an informal, friendly community of photographers are in particular the supply of so-called blogs for grouping of photographers with common interests and the possibility of the interactive declaration of friendships.

fincy photshop sets so-called Cookies.
These serve the data acquisition in particular for the collection of photos in a shopping basekt and for the security of the application.
These Cookies are only stored on the computer of the user of fincy photoshop.
The duration time of the set Cookies is limited at the latest to one month.

As script languages fincy photoshop uses html, css, php, mysql, xml and javascript.
For an error free use of fincy photoshop Javascript must be permitted on the computer of the user.

fincy photoshop functions are tested on web browsers of the brands MS Internet Explorer version 6, version 7 and Mozilla Firefox version 1.5, version 2, version 3.

fincy excludes liability from damage caused by incorrect web browser settings.
fincy excludes liability for incorrect data communication.
fincy excludes liability from damage caused by strange user activities, which lead to technical errors or overruns.
fincy excludes liability for losses, generated by illegal downloads.
fincy excludes liability for contents of the provided web space.
fincy excludes liability for transport damages or late or missing supplies of physical products caused by third parties.
fincy preservere to serve a technically correct execution of the software and the protection of copyrights of the respective member.
In no case fincy takes liability for damage and/or lost profits, which results from incorrect technical functions or incorrect and/or incomplete data transactions.

The member has to be the owner of an uploaded photo and does not insure copyrights of third parties with the upload of photos and texts.

With the upload of a photo the owner of the photo grants fincy the unrestricted right to copy, multiply and change the photo for the purpose of sale as download and/or as print on Gadgets in the fincy photoshop.

Changes concern the print of a label as reference on copyrights, the size of the photo, the representation of the photo on Gadgets and the print on Gadgets for the purpose of sale.

Multiplied and/or changed photos are property of the respective member.
With a selling of a photo the owner of the photo grants the buyer the unrestricted right to copy, multiply and change the photo.
fincy keeps the right to place advertisement in fincy photoshop.

Product designations, label names and logos are property of the respective advertising partners, even if these are not separately characterized.
Copying, multiplying, selling, changing or reselling of the source code of fincy photoshop or parts of the source code of fincy photoshop without permission in the written form is forbidden, if not expressly mentioned.
The services of fincy photoshop and the source code of fincy photoshop are world-wide in copyright matters protected.

Each member receives for the download a original photo and the use of a photo as print on a Gadget 60% of net proceeds without deduction of the costs of server enterprise and maintenance.

Permissible deductions of gross proceeds are the costs of the production of Gadgets, delivery costs, financal transaction costs as well as 5% of the gross proceeds to generate a reserve for the grant of justified fair trading payments in the sense of the customer.
Money transactions in favor of the member take place monthly free of charge using paypal or on a bank account of the member, if the obtained assets of the member exceed the amount of 100 €.

The member is not allowed to publish texts with immoral contents the publication of political propaganda and discriminating texts in fincy photoshop.
The member is not allowed to publish photos with immoral contents in fincy photoshop.
Immoral contents are in particular photos of clear pornographic actions, photos of excrements, representations of violance against the will of the involved ones
( pornographic photos can be published at love.fincy.com.)
In the case of a violation of the morals fincy keeps the right to delete the web space and the personal data of the member irrevocably.
In the case of an unlawful violation of the morals fincy keeps the right to give the personal data of the member and the photo to the concerned authorities if demanded.

fincy commits itself to the careful handling of stored data of the member. fincy commits itself not to pass personal data of the member to third parties. (Exception: see “morals”)

In particular fincy commits itself not to use personal data of the member for advertising purposes.

fincy commits itself to use personal data of the member exclusively tied for a functional enterprise of fincy photoshop.

The use of the collected data takes place on own risk.
fincy does not ensure that the offered use of fincy photoshop will be availbale anytime without interruption, time-fairly, reliably and error free for order stands.
fincy does not guarantee that the supplied products expectations of the customer corresponds.

This gtc as well as the use of fincy photoshop determine themselves according Swiss rights.
